The mobile application Coach Me (“Coach Me”, “our” , “us”, or “we”) and the website coachme.co.in is owned by 23 Yards Coaching and Softwares Pvt. Ltd. (“Company”) ; dedicated to providing curated eLearning content with an aim of promoting sports. It is created for the benefit and protection of all users of the Platform referred to as “Learners”, “Users” “You”, “Your”. We offer our services on or through the Website and/or through the mobile application(s) (collectively referred to as the “Platform”).

This Privacy Policy applies to all the User/s of this Platform. This Privacy Policy applies to the Data collected by us or provided by you voluntarily in relation to on our Platform. 

We regularly update, improve and expand the Platform which may result in a policy change, so please refer back to it periodically and read it carefully.

At 23 Yards, we collect, process and protect your personal data in accordance with the Digital Personal Data Protection Act, 2023 and other national and state laws that relate to the processing of personal data.

Scope

This Privacy Policy applies only to the actions of Company and its Users with respect to this Platform. It does not extend to any third party Platforms that can be accessed from this Platform including, but not limited to, any links we may provide to social media Platforms.

For purposes of the Platform and Data Protection Laws, Company is the "data controller". This means that Company determines the purpose and manner of your Data is processing.

Data collection

Company may collect the following Data, which includes personal as well as non-personal identifiable information when you visit our Platform, register or engage activities, services or resources offered.

 

(A) Voluntary Information

When the User register’s on the Platform, Company may ask for basic information such as name, age, sex, address, pin code, contact no. , occupation, interest and email address; which we may retrieve to continue to interact with you and to provide Services.

 

For any subscription or paid services of Company or its payment gateway provider may collect User’s purchase, address, billing information including your credit card and expiry date.

 

Company may also collect additional information at other times, including but not limited to, when you provide feedback, change your content or email or preferences, respond to a survey or communicate with us.

 

(B) Information Automatically collected

Company may use cookies or web beacons to collect information to improve the responsiveness of the Platform make improvements to Platform content and navigation which may include User’s IP address, the date, times and frequency with which User accesses the Platform and the way User uses and interacts with its content. Company may assign each subscriber a unique random number as a User Identification (User ID) to understand the individual User interests using identifiable computer if User has subscribed its Services. Company will collect User Data automatically via cookies, in line with the cookie settings on User’s browser. Company has no way of knowing the User unless the User identifies herself/himself through registration.

Purpose & Use of Data

Company collects Personal Information of User for the following purposes :

Data Sharing

Company may share User Data with the following groups of people for the following reasons:

  1. Company employees, agents and/or professional advisors; to understand who we are providing coaching services to and what areas of speciality we need to focus on;

in each case, in accordance with this privacy policy.

  1. Company may present information to its advertisers; to help them understand its audience and confirm the value of advertising on Company Platforms or applications – however it is usually in the form of aggregated statistics on traffic to various pages within our site.

  2. Company may share User information regarding User activities on Platforms or applications with third party social Platforms to populate User’s social wall that is visible to other people however User will have an option to set his/her own privacy settings, to decide what User would like to share or not to share with others.

  3. When it is requested or required by law or by any court or governmental agency or authority to disclose, for the purpose of verification of identity, or for the prevention, detection, investigation including cyber incidents, or for prosecution and punishment of offences. These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing these Terms or for complying with the applicable laws and regulations.

Data Security

Company uses standard technical and organisational measures which include measures to deal with any suspected data breach to safeguard User Data, for example -access to User’s account is controlled by a password and a user name that is unique to every User.

Third party access: Company safeguards information against unauthorised access, use, alteration or destruction. Company is not responsible for third party Platforms or content.

Cross border data transfer : All data is stored on secure servers; however User information may be stored, processed or transferred internationally.



User Rights

The User may choose to limit the information provided as well as limit the communications received. The User may reject cookies by adjusting browser settings. This may however affect the services and functionality of the Platform.

Data Retention

All information collected, accessed or processed by Company will be retained only as long as necessary for the fulfilment of the purposes for which it was collected, unless otherwise authorized or required by law. Personal information that is no longer required to fulfil the identified purposes will be destroyed, erased or de-identified. Company may keep some information on its servers or backup system in order to enhance functionality of its services after the information is deleted, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.

Links to other Platforms

Company Platform may, from time to time, provide links to other Platforms. We have no control over such Platforms and are not responsible for the content of these Platforms. This privacy policy does not extend to the use of such Platforms. User’s are advised to read the privacy policy or statement of other Platforms prior to using them.

Children’s Data

Section 2(f) of the Digital Data Protection Act, 2023 defines a child as “an individual who has not completed the age of eighteen years.”

Company does not allow minors/children to register and/or use the Platform. If User is below the age of 18 (“Child User”) then as per applicable law, the use of the Platform must be with the consent of/enabled by, and under the supervision of, a parent or legal guardian (“Parent”). If a Parent, by allows a child to access/use the Platform, it is deemed acceptance of this Privacy Policy so as to form a legally binding and enforceable contract between User ( in this case the Parent being the legal guardian) and Company.

(a) General Rules

Company may collect Personal Information from children under the age of 18 in certain areas of the Platforms and services but only with affirmative parental consent. If Company has collected or received personal information from a child under 18 without verification of parental consent, we will endeavour to delete that information. 

(b) Information Collected and Parental Rights

If the child wants to register on the Platform, Company will only allow such registration/participation to proceed only upon affirmative parental consent. During the registration process, Company may collect certain information from the child, including personal information such as child’s name or e-mail address, as well as a parent or guardian’s email address in order to obtain your affirmative consent. 

(c) Information Use and Disclosure

Personal Information collected on or through any portions of our Services that are directed to children under 18 may be shared with service providers with whom we contract to operate the Services. However, we will not share any personal information collected from children through our Services to our service providers, partners or any other third party in connection with sports betting and gaming services. As set forth above, we endeavour to maintain the confidentiality, security, and integrity of the personal information collected from your child. Other than our Service Providers and as described above, we will not share your child’s personal information with third parties. We may also collect, use and disclose this personal information as described in the other sections of this Privacy Policy.
